Category: Methodology

So if the teacher orders the Hajr of an individual and for him to be dropped and alienated or the like, then the affair is looked into, if he committed a sin (which Islaam recognizes as being a sin), then the person is punished according to the level of his sin, without increasing upon that and if he did not commit a sin, then it is not allowed, that he be punished with anything in order to fulfill the goal of the teacher.

Along with this, it is not for the teachers to make people into groups (parties) nor to do what will make the people encounter enmity and hatred. Rather they should be like brothers, co-operating with each other upon righteousness and piety, as the most high has said:

"And co-operate upon righteousness and piety and do not co-operate upon sin and transgression." (Al-Ma'idah:2).

.So it is not for anyone from amongst them to take another upon a contract, in order to make the person agree with everything that he wants and to have alliance to whomever he has alliance to and to have enmity for whomever he has enmity for. Rather whoever does this, then this is the same type of action done by Gengias Khaan and his like, those who make (whoever agrees with them) a friend and an ally and whoever disagrees with them an enemy and an oppressor. Rather what is upon them and their followers is the contract of Allaah and His Messenger, that they obey Allaah and His Messenger and that they do what Allaah and His Messenger ordered with, and to make haraam what Allaah and His Messenger have made haraam and to take care of the rights of their teachers as ordered by Allaah and His Messenger. So if one of the teachers is oppressed then he aids him and if he is the oppressor then he does not help him in that oppression, rather he prevents him from that, as is authentically established from the Prophet (may Allaahs prayers and peace be upon) that he said:

"Help your brother; be he the oppressor or the oppressed. It was said O Messenger of Allaah, I shall help him if he is oppressed but how do I help him if he is the oppressor? He said: Prevent him from oppression, that is how you help him [while he is the oppressor]." (Bukhaaree and Muslim).

So if there was to occur between a teacher and a teacher or a student and student or between a teacher and a student a dispute or a quarrel, it is not allowed for anyone to aid and help either of the two parties until he knows the truth, so he does not help with ignorance nor with desires, rather he looks into the affair.

So if the truth is made clear to him, he helps the one who is upon the truth against the one who is upon falsehood, whether the one upon the truth is from his companions or from the companions of another and whether the one upon falsehood is from his companions or from the companions of another. So the purpose is to worship Allaah alone and to obey His Messenger and to follow the truth justice. Allaah the most high has said:

"O you who believe! stand out firmly for justice, as witnesses to Allaah, even though it be against yourselves, or your parents, or your kin, be he rich or poor, Allaah is a better protector to both (than you).So follow not the desires, lest you avoid justice; and if you distort your witness or refuse to give it, verily Allaah is well aware of what you do." (An-Nisaa:135).

It is said; to distort means to lie and to refuse means to conceal the truth. And indeed the one who keeps silent (while he witnesses Falsehood) while he knows the truth is a speechless Shaitaan.

So whoever leans towards his companion, whether the truth is for him or against him, has verily ruled with the ruling of the days of Jaahiliyah and has left the ruling of Allaah and His Messenger.

So it is obligatory upon all of them to have one (united) hand with the one upon the truth against the one upon falsehood, so that the one who is glorified with them is the one whom Allaah and His Messenger glorify and the one put forward is the one whom Allaah and His Messenger put forward and the one who is loved with them is the one whom Allaah and His Messenger love and the humiliated one with them is the one whom Allaah and His Messenger have humiliated, in accordance with what Allaah and His Messenger are pleased with, not in accordance with desires, because whoever obeys Allaah and His Messenger is indeed guided and whoever disobeys Allaah and His Messenger, then he causes no harm except to himself.

فاذا كان المعلم او الاستاذ قد أمر بهجر شخص او باهداره واسقاطه وابعاده ونحو ذلك نظر فيه فان كان قد فعل ذنبا شرعيا عوقب بقدر ذنبه بلا زيادة وان لم يكن أذنب ذنبا شرعيا لم يجز ان يعاقب بشئ لأجل غرض المعلم او غيره وليس للمعلمين ان يحزبوا الناس ويفعلوا ما يلقى بينهم العداوة والبغضاء بل يكونون مثل الأخوة المتعاونين على البر والتقوى كما قال تعالى ( وتعاونوا على البر والتقوى ولا تعاونوا على الاثم والعدوان( وليس لأحد منهم ان يأخذ على أحد عهدا بموا فقتة على كل ما يريده وموالاة من يواليه ومعاداة من يعاديه بل من فعل هذا كان من جنس جنكزخان وأمثاله الذين يجعلون من وافقهم صديقا والى ومن خالفهم عدوا باغى بل عليهم وعلى أتباعهم عهد الله ورسوله بأن يطيعوا الله ورسوله ويفعلوا ما أمر الله به ورسوله ويحرموا ما حرم الله ورسوله ويدعوا حقوق المعلمين كما أمر الله ورسوله فان كان أستاذ يمط كما ثبت فى الصحيح عن النبى صلى الله عليه وسلم أنه قال ( انصر أخاك ظالما او مظلوما( قيل يا رسول الله أنصره مظلوما فكيف انصره ظالما قال ( تمنعه من الظلم فذلك نصرك إياه( واذا وقع بين معلم ومعلم او تلميذ وتلميذ او معلم وتلميذ خصومة ومشاجرة لم يجز ألأحد ان يعين أحدهما حتى يعلم الحق فلا يعاونه بجهل ولا بهوى بل ينظر فى الأمر فاذا تبين له الحق أعان المحق منهما على المبطل سواء كان المحق من أصحابه او أصحاب غيره وسواء كان المبطل من أصحابه او أصحاب غيره فيكون المقصود عبادة الله وحده وطاعة رسوله واتباع الحق والقيام بالقسط قال الله تعالى ( يا أيها الذين آمنوا كون كونوا قوامين بالقسط شهداء لله ولو على أنفسكم او الوالدين والاقربين إن يكن غنيا او فقيرا فالله أولى بهما فلا تبعوا الهوى أن تعدلوا وإن تلووا أوتعرضوا فان الله كان بما تعملون خبيرا( يقال لوى يلوي لسانه فيخبر بالكذب والاعراض ان يكتم الحق فان الساكت عن الحق شيطان أخرس ومن مال صاحبه سواء كان الحق له او عليه فقد حكم بحكم الجاهلية وخرج عن حكم الله ورسوله والواجب على جميعهم ان يكونوا يدا واحدة مع الحقى على المبطل فيكون المعظم عندهم من عظمه الله ورسوله والمقدم عندهم من قدمه الله ورسوله والمحبوب عندهم من أحبه الله ورسوله والمهان عندهم من أهانه الله بحسب ما يرضى الله ورسوله لا بحسب الأهواء فانه من يطع الله ورسوله فقد رشد ومن يعص الله ورسوله فانه لا يضر إلا نفسه
